Trustworthy villa rentals in Orlando

The following Terms & Conditions or Rental are here to protect both your interests and those of the owner - if you have any concerns about any of the conditions below, please contact us at enquiries@iwantavilla.com and we will be happy to address your concerns.

Bookings

Bookings from single-sex groups are not accepted - in other words, owners will not allow Stag/Batchelor & Hen/Bachelorette parties or similar due to the high risk of property damage - Golfing Groups are excluded at the vacation home owner's discretion.

The online Booking Form must be completed and terms accepted (tick box) by the party leader (the client) who must be aged 28 years or over (in compliance with Orlando Codes of Ordinances – Chapter 57).

To secure a vacation home booking, a non-refundable BOOKING DEPOSIT (not SECURITY DEPOSIT - see below) of 25% of the total rental cost or a minimum of £300 / $450 is charged, which should be paid directly to the owner within 5 working days of the date of initial booking confirmation. Failure to pay the deposit within this period (without prior agreement from the owner) may result in your booking being cancelled. The balance of the cost must be paid no later than 10 weeks prior to the rental start date. If the booking is made within 10 weeks of the rental start date, then full payment must be made at the time of booking. Under special circumstances (by prior agreement with the owner) you may pay over a longer period or payment in instalments. See below about options for methods of payment.

Security Deposit

Unless an owner operates a Credit Card Swipe on Arrival and/or Rental Damage Insurance facility, then a conditional refundable Security Deposit will be added to the final balance to cover any breakage or damage whilst staying in the vacation home and will be clearly mentioned after you start the booking procedure by clicking the BOOK NOW button.

If a particular owner offers Credit Card Swipe on Arrival and/or Rental Damage Insurance facility then you will be advised of this when progressing to booking the vacation home after clicking the BOOK NOW button - If this is the case, you will notice that there will be no mention of a Security Deposit in the online breakdown of costs in the right-hand side panel on your screen.

The lead name on the booking form is solely responsible for any damages or breakages that may be caused to the vacation home or its contents. In the event of a Security Deposit being charged, all or part of the security deposit may be retained by the owner to cover excess cleaning costs, replacement or repairs to the property or its contents, excessive utility bills i.e. external doors being left open whilst the air-conditioning is on causing excessive electricity usage and/or freezing/damage of AC unit. Any defects found on arrival must be notified to the Management Company within 24 hours of arrival or you may be held liable.

THE SECURITY DEPOSIT IS REFUNDED WITHIN 28 DAYS (OR SOONER) OF DEPARTURE FROM THE VACATION HOME, SUBJECT TO ANY DAMAGE OR MISSING ITEMS.

Paying By Credit/Debit Card Via Secure Payment Portal

Most of our owners in addition to offering bank wire transfers and/or check payment may also offer the option of paying by Credit/Debit card either through the secure STRIPE or PayPal payment portal provided by our website or via their management company's own credit card payment facility.

Credit & Debit card payments are by default handled through our secure Online Payment Portal provided by STRIPE for which there is NO SURCHARGE for all card types. Nearly all our owners have signed up to our secure credit card payment facility that we offer through STRIPE, but in the event that an owner is not signed up to STRIPE, they may still be using an alternative option through their management company or PayPal for which there may be a SURCHARGE applied. All villa listings offering credit card payment options display the credit card icon under their photos on their listing.

Payment by other means such as by Bank Transfer, Internet Banking or Cheque DO NOT carry a surcharge either but may have transaction charges from the banks involved. You will be informed by the owner of the vacation home that you are booking on what alternative payment options are available to you when they contact you after completing and submitting the booking form online.

If you cannot decide which payment method you want to use during the booking process, you can still pay by credit card retrospectively after booking by requesting that the owner send you a secure STRIPE or PayPal credit card payment request by email.

Financial Protection

Please note that paying with a credit card (not a debit card) will give you an increased level of financial protection as long as it is through a credit card payment facility like that offered by STRIPE of PayPal - if paying via PayPal, please DO NOT log into PayPal as paying with a PayPal account itself does not give you ANY financial protection.

Cancellation Policy

By Client - Any cancellation by the client must be notified in writing to the owner. The following charges will apply as the chances of the owner securing a booking at such short notice is very difficult:

  • More than 10 weeks - the deposit paid is forfeited
  • 70 - 57 days - 40% of rental charge forfeited
  • 56 - 43 days - 60% of rental charge forfeited
  • 42 - 29 days - 80% of rental charge forfeited
  • 28 days or less - 100% of rental forfeited

By Owner - The owner or their appointed management company reserves the right to cancel the booking if the balance payable is not received 10 weeks prior to the start of the rental period (or an alternative agreed payment deadline with the owner). If through circumstances beyond the owner’s or their appointed management company's control it is necessary to cancel the rental agreement, the owner or their appointed management company may offer what we deem a suitable alternative vacation home of the same standard or better and only in the event that no suitable alternative vacation can be offered, only then will you be refunded any monies paid to the owner or management company (less card transaction charges), without interest or further compensation usually by the same payment means as it was paid to the owner or their appointed management company. This clause is overridden by the Force Majeure clause below if relevant.

In the event of an owner selling their home, you will be notified immediately we are made aware. In the event that the new owners have purchased the home with bookings in place, we will endeavour to ensure a smooth transition so your booking is unaffected. In the event that the new owners of the home do not wish to rent out the home for vacation purposes, you may be offered what we deem a suitable alternative vacation home of the same standard or better and only in the event that no suitable alternative vacation home can be offered, only then will you be refunded any monies paid to the owner or management company (less card transaction charges), without interest or further compensation usually by the same payment means as it was paid to the owner.

In the event of an owner cancellation or loss of availability as detailed above, I Want A Villa will do everything in their power to find you suitable alternative accommodation of similar or better quality/specification as the original home booked.

Force Majeure

The owner or their appointed management company do not accept any liability whatsoever and no compensation or other payment will be made for loss, damage or injury caused by Force Majeure (e.g. war, strikes, adverse weather, disasters, viral pandemic, transportation or other events beyond the owner’s control).

THE CONTRACT OF RENTAL IS STRICTLY BETWEEN WITH THE OWNER / MANAGEMENT COMPANY OF THE PROPERTY AND THE LEAD NAME ON THE BOOKING FORM - THERE IS NO CONTRACT WITH THE IWAV WEBSITE WHICH PURELY SERVES AS AN INTRODUCER.

THE OWNERS OF THE IWAV WEBSITE CANNOT BE HELD LIABLE WHATSOEVER FOR ANY DISAGREEMENT OR CONFLICT WITH THE OWNER / MANAGEMENT COMPANY OF THE PROPERTY RENTED - REFER ALL CORRESPONDENCE TO THE PROPERTY OWNER / MANAGEMENT COMPANY

Viral Pandemic - Special Terms

In the event that you are unable to travel to Florida as a result of flight restrictions/disruptions due to closed borders following a Viral Pandemic and/or Government Advice not to travel (i.e. FCO in the UK or CDC in the USA), we will endeavour to be as flexible as possible in order to reschedule your stay (with the owner and/or management company agreement) to a future date when travel is not restricted. We or the owner/management company cannot offer a refund but can carry forward the credit of monies already paid for future dates ideally within 6 - 8 months of the original dates booked, or possibly longer if the pandemic restrictions persist subject to the owner/management company's agreement, we could reschedule your booking up to 24 months in the future but cannot guarantee this with all bookings.

In the event a booking has been rescheduled to future dates due to inability or desire to travel, the cancellation terms will remain based on the original dates booked and not on the rescheduled dates.

Common Courtesy

Communication is the secret to a successful booking - please do not ignore the owners request for payment - if you decide not to proceed with the booking, please let the owner know so they can release the dates and hopefully gain another booking - your booking will have blocked off dates on their calendar preventing them from gaining another booking - we are all human after all and deserve respect. Failure to observe common courtesy may result in you being permanently blocked from booking any other homes on this website.

Occupancy Levels

The person who completes the Booking Form certifies that he or she is authorised to agree to the booking conditions on behalf of all persons included on the Booking Form, including those added or substituted at a later date. The client must notify the owner of any such changes immediately they are known as Florida State Law prohibits subletting, sharing or assigning. Therefore, only the persons named on the booking form are allowed to stay in the villa. The Management Company on arrival may verify the persons occupying the villa. As a general rule, the number of occupants must not exceed the following (although an owner may stipulate a lesser or higher figure on their listing).

  • 6 persons in a 2 bedroom vacation home
  • 8 persons in a 3 bedroom vacation home
  • 10 persons in a 4 bedroom vacation home
  • 12 persons in a 5 bedroom vacation home
  • 14 persons in a 6 bedroom vacation home
  • 16 persons in a 7 bedroom vacation home

The above is only a guideline - the owners listing will designate the maximum number of occupants they will accept and this takes precedence.

When you book a vacation home, you are booking the WHOLE HOME - there are no discounts for under-occupancy as we cannot rent part of the property to you. You would not be happy if we rented the unused portion of the property to total strangers, so please do not expect to receive, or request a discount for under-occupancy. There is no financial benefit to the owner for under-occupancy.

Booking of the property infers your agreement with the booking terms and conditions even if the automated email copy of the booking form has not been subsequently received by email due to spam filters etc...

Amendments

Alterations/amendments after the booking has been confirmed can be made at the owner’s discretion and you will be informed of any changes made.

Arrival/Departure

The vacation home is available after 4:00 PM (local time) on the day of arrival and must be vacated by 10:00 AM on the day of departure (unless otherwise agreed by the owner). By prior arrangement with the owner, earlier arrival and later departures times may be possible (subject to other bookings in place).

The vacation home rental is only for the dates and times agreed to in the rental contract. Any attempt to enter the property before the agreed-upon time is not acceptable and any violation will result in you being charged double the daily rate for each day (or portion of a day) that the property is occupied outside the agreed rental dates and times. Failure to leave the property after the agreed departure time will result in eviction and the Sheriff may be called to assist. Deductions will automatically be made from your security deposit.

Price Guarantee

The prices quoted are subject to change. However, the rental price for the vacation home is fully guaranteed once the deposit has been paid and the acknowledgement/receipt has been issued by the owner.

In the situation of a booking being made in a particular currency and the owner rightfully acknowledges the booking in another currency at the current exchange rate at that time (i.e. booking made in GBP and US Owner converts to US Dollars) - the owner may then specify the balance amount (where applicable) payable at a later date in the currency of their choice - the acknowledged amount in the currency specified by the owner stands regardless of subsequent fluctuations in currency exchange rates.

Website Description

The website is a guide to the quality and description of the vacation home only and does not form part of any contract. The owner or their Management Company reserve the right to make any modifications deemed necessary. In the event that unintentional errors, mistakes or omissions occur we cannot accept any liability for these details. In the unlikely event that circumstances beyond our control necessitate the cancellation of the arrangements, we reserve the right to take all reasonable steps to find & offer you alternative suitable accommodation.

Vetting of Vacation Home Owners & Their Homes

All owners of vacation homes on our website are fully vetted against public records to ensure that the owner actually owns the property and that they are financially sound with regard to property taxes & HOA fees.  We have been offering vacation home rentals since 2002 and have not had a single problem with any of our owners.  We take the credibility of our website VERY seriously and if any owner should affect our website's credibility we remove them and their home(s) immediately. Please refer to the numerous genuine guest reviews posted on the website.

Liability

No liability is accepted by the owner or their Management Company whatsoever for death, personal injury, accidents, loss or damage to persons or personal effects however caused as a result of the use of the vacation home or pool. This waiver extends to people visiting the vacation home as a guest of the client(s).

The owners or agents will not be liable for loss or delay occasioned by strikes, riots, political unrest, hostilities, war, terrorist activity, industrial disputes, fire, flood, hurricane, tornado, technical/weather, problems with transport, aircraft grounding, closure of airports or ports, weather conditions or any other event beyond the owner's or agent's control.

The vacation home is situated in a community, which consists of both residential and vacation homes. The owner or their Management Company cannot be held responsible for any ongoing construction or alterations to existing villas or any noise on or around the community.

IT IS STRONGLY RECOMMENDED THAT CLIENTS TAKE OUT ADEQUATE TRAVEL INSURANCE TO COVER CANCELLATION FEES AND ANY OTHER LOSSES, WHICH MAY OCCUR.

It is the responsibility of the client to ensure that all those travelling in the party have complied fully with all passport and ESTA requirements in place at the time of travel (Children including infants have to have their own passports). Any failure in this respect may result in your travel arrangements being amended and/or curtailed with consequential losses in respect of your villa booking. In such circumstances, no liability attaches itself to the owner or I Want A Villa.

Alarm Systems

Where an alarm system is fitted to a vacation home you are required to set it whenever you leave the home unoccupied (i.e. visiting the parks, vacating the home etc...). Please familiarise yourself with its use as soon as possible - if in doubt, contact the management company. Failure to comply with this condition will result in you potentially being held liable by the owner for any losses & damages incurred to the owner's property in the event of a break-in by an unauthorised person or persons. The alarm system also serves to protect your own possessions as well - so use it. In the unlikely event that there is a break-in and you have incurred a loss, the owner is not held liable for this and if you decide to move out, the owner is not required to refund any rental monies or additional expenses you may incur as a result of your decision to vacate the property.

Swimming Pool Area

Use of the swimming pool is at the client’s own risk. Guests are specifically advised not to allow unsupervised children near the pool. No diving is allowed. No glass of any kind is allowed in the pool area.

If pool heating is required, this should be requested at the time of booking. An additional charge will be levied (see rates tables on vacation home listings) and must be paid for when settling the final balance. If not initially requested but subsequently heating is required, the Management Company may levy an additional local daily fee to cover their call-out. The maximum legally permitted temperature owners are allowed to heat the pool water is 86°F (30°C) - please do not request anything higher.

Please be aware that it is not possible to guarantee the temperature of the pool, which is partially dependant on the local weather conditions. If the outside air temperature drops below 55°F (13°C) the owner cannot guarantee that they can maintain the pool temperature at a comfortable temperature. Please always use the insulating pool blanket (when provided in colder months) to help to maintain the pool heat when the pool is not in use. Failure to use the pool blanket will result in excessive electricity charges which may be deducted from your security deposit.

Why You Should Use The Pool Blanket Provided

When the air temperature is cold and if you don't have a pool blanket the pool could lose anywhere from 7 to 15 degrees of temperature overnight. The average pool heater is capable of heating the pool at a rate of 1 - 2 degrees per hour

You don't need to be a genius to figure that if you are losing 15 degrees overnight and only putting maybe 12 degrees back in during the day - the pool is never going to be warm.

With an insulating pool blanket in place, the pool may only lose 2 degrees overnight so you should be able to see the benefit straight away how this makes a difference.

Pool Equipment

Tampering with any of the pool equipment and controls is strictly forbidden. Overriding the pool heat controls to heat the pool when it has not been paid for is considered as theft and will be reported immediately to the Sherriff's Department. In addition, failure to comply with the above will result in immediate eviction from the property with full loss of all monies paid and security deposit.

Use of Utilities

Normal usage of gas, water, telephone & electricity is included in the rental price. You will be subject to the full costs of any additional charges if utility and/or telephone bills for the period of your stay are in excess of 10% above normal usage. Cable TV is provided and is included in the rental price. Please note that electricity is VERY expensive in Florida with typical monthly bills amounting to more than $250 upwards, so please use electricity wisely.

Charging of Electric Vehicles

Charging of electric vehicles is considered MORE THAN NORMAL USAGE OF ELECTRICITY and therefore without express permission in writing from the owner or management company you are not allowed to charge your vehicle from the property's electricity supply. Failure to comply will result in the deduction of your security deposit or your credit card by the value of excess electricity consumed plus 20%. With time owners will start to install EV chargers on their properties and will offer financial arrangements so guests can utilise these facilities and pay for the electricity supplied to charge your EV - until then, do not plug your EV in.

PLEASE DO NOT BE TEMPTED TO STEAL ELECTRICITY AS IT WILL BE IMMEDIATELY OBVIOUS TO THE OWNER WHEN THEY RECEIVE THEIR MONTHLY ELECTRICITY BILL.

Furniture

No furniture may be moved beyond the rooms in which it is installed without the written authorisation from the owner.

If during your stay you find it necessary to reposition furniture within a room, then please do so with extreme care and reinstate everything to its original location before your departure.

Any damage resulting from the moving of furniture will be charged to you. If the owner's agents have to move furniture back after your departure the owner will charge the cost of this to you, as it entails sending staff specifically to the property to undertake this task. The costs incurred will be deducted from your security deposit.

Computers & Internet Access

Very few owners offer a computer as there are legal implications in providing a computer that could be used to download copyrighted, illegal or offensive material. In the USA this is strictly monitored and the owner of the internet connection (i.e. the vacation homeowner) is held legally liable for copyright infringement. In addition, inappropriate adult material could also be downloaded and children from future guests could be exposed to such material.

Therefore, vacation homeowners tend only to offer internet access and leave it to the renters to bring their own Laptop, Tablet Computer or Smart Phone to access the internet – this way the owner can clearly demonstrate to the authorities that the renter is liable for copyright infringement as the receiving equipment of such material was the property of the renter and not that of the property owner.

Please note that if the owner offers a computer in their vacation home, then the owner will hold you liable for any date stamped copyright infringement or illegal downloads and will pass your details onto the authorities. For the protection of future guests (particularly children) please do not access inappropriate material and if subsequently, it is found that such material (especially illegal material) has been accessed and/or downloaded, the renter's details relating to the date stamp of the offence will be passed onto the authorities. Please ensure all guests in your party are made aware of this.

Loss, Damage & Condition of the Property

The owner's management company will advise the owner of any loss or damage to the villa following your departure. They will also provide a full report on the general condition/cleanliness of the property. Guests are expected to leave the home in a reasonable and tidy condition. The owner will seek full reimbursement from the lead guest for any loss or damage incurring during the duration of their stay. The owner will seek full reimbursement from the lead renter for any additional cleaning costs above the normal as a result of their stay. Any loss, damage or cleaning fees costing in excess of the security deposit amount will be fully reimbursed by the lead guest within one week (7 days) of departure. Guests are required to remove their trash/rubbish from the villa. Failure to comply will result in a minimum charge of $75.

Smoking Policy

For the comfort and safety of our guests, smoking is not permitted anywhere in the home. However, guests may smoke in the pool area and surrounding gardens. Resin ashtrays are provided for guests use. If a particular owner completely forbids smoking in and around their home (including the pool deck), this will be mentioned in the property listing and this condition overrides the above.

If guests are found to have smoked inside the villa, the full security deposit will be forfeited to cover the costs of cleaning the Air Conditioning System and fumigating furnishings etc... We reserve the right to pursue the lead guest for any additional charges as a result of having to relocate future guests whilst the villa is being cleaned and fumigated.

Floridas Natural Fauna - Reptiles, Amphibians, Insects & Pests

Reptiles, amphibians, insects and other pests are inevitably present in Florida's tropical climate and were there first before humans invaded their habitat. Within reason, this is normal and the owner cannot take action to totally eradicate the problem but only control it. All properties receive periodic pest control treatment. Only when, in the owner's reasonable opinion, pests in the living accommodation become a serious nuisance will further action be taken. Please contact the management company ASAP if you experience a problem with any reptiles, amphibians, insects or other pests and they will act accordingly. Failure to report a problem immediately cannot be deemed an excuse by the renter to claim compensation.

Finding a reptile or ants in the accommodation or on the pool deck does not warrant cancellation of the rental as they are easily removed and have no bearing on the cleanliness of the property - If a client decides to cancel their booking on arrival due to this, they do so with the full understanding that they forfeit ALL monies paid.

Animals & Pets

Animals and Pets are not permitted in the home. This condition is strictly enforced. Failure to comply will result in you being asked to leave the vacation home without any compensation and the full security deposit will be forfeited to cover the costs of professional cleaning the carpets and furnishings etc...

Resort Facilities

Use of resort facilities outside of the rented property is strictly at the renters and renters family/group own personal risk - for your own personal security and safety, you are required to follow all safety notices and restrictions posted around the resort. The owner of the rented property cannot be held legally responsible for any loss or injury sustained whilst on or off the resort.

Submission of the booking form constitutes acceptance of a contract based on these terms subject to the laws of the UK (for UK/European guests) and the USA (for all other guests) which shall apply to this contract and any other claims.
